NOTICE OF MOTION
TAKE NOTICE that on the 11th day of December 2018 at 10.30 o’ clock in the forenoon, or at the first available opportunity thereafter, or any adjournment thereof, before this Honourable Court, at the Four Courts, Inns Quay, in the City of Dublin, Counsel on behalf of the Plaintiff will make Application for:
(a) An Order for Judgment against the Fifth Named Defendant in the terms as set out and sought in the Personal Injuries Summons issued and then served on the said Defendant by substituted service, on the grounds that he has failed, neglected and/or refused to enter an Appearance within the time so limited by the Rules of this Honourable Court or at all;
(b) An Order that the damages to which the Plaintiff may be entitled on foot of said Judgment against the said Fifth Named Defendant be assessed by a Judge of this Honourable Court at Trial;
(c) An Order providing for the costs of the Application.
WHICH APPLICATION will be grounded upon the Personal Injuries Summons issued and served herein, the Order for Substituted Service dated 16th day of December 2016, the Affidavit of Service of said Personal Injuries Summons, the Affidavit of Verification of same, the Certificate of No Appearance, the nature of the case, and the reasons to be offered.
